Council prosecutes Ellesmere Port woman linked to fly-tipped waste in Crescent Road

An Ellesmere Port woman has been ordered to pay a total of £1,410 after being prosecuted by Cheshire West and Chester Council for a fly-tipping offence.

Nikisha Warren (43), of Shephard Close, Ellesmere Port, was fined £660 and ordered to pay costs of £486 and victim surcharge of £264. The defendant has 28 days to make payment.

The waste was found in an alleyway between Crescent Road and Shephard Close, Ellesmere Port on 17 May 2024.

The Council’s Public Protection team investigated the waste, which was linked to Ms Warren’s address. It included three bin bags containing women’s clothes, a sofa, a trolley a cardboard box.

On 23 May 2024, the defendant was invited to interview but failed to attend. On 19 June 2024, she was issued with a fixed penalty of £400. No payment was received.

The defendant then failed to attend two hearings and was subsequently arrested under warrant. She was brought before the court on 2 May 2025, where she pleaded guilty to depositing some, but not all, of the waste found on the site.

She admitted to the bin bags and box but denied the sofa and trolley, arguing that the area is a known hot-spot for fly-tipping.

On the day of the hearing, the judge adjourned the matter for a pre-sentence report to be produced. Although the defendant remained in communication with the court and probation throughout the process, she failed to attend the sentencing hearing. As a result, the magistrates proceeded with sentencing in her absence.

Councillor Stuart Bingham, the Council’s Cabinet Member for Neighbourhood Pride and Community Safety, said:

This case demonstrates the dedication of our Public Protection officers. We will not accept fly-tipping in our borough and will take action against offenders every time.  Failing to engage with us, like this defendant tried, will not make the problem go away.

Please help us tackle this problem and report inconsiderate fly-tippers, who still think they can dispose of rubbish wherever they want causing problems for residents and draining Council services.
