Who will own my data once I submit it?

We will own your data once it has been submitted.

Why do you need my information?

The fostering better outcomes programme is a new type of placement for children in care. It will provide high intensity foster care, as an alternative to residential care. We need information to ensure children and young people are safe and well, and that this new type of placement is supporting people appropriately. We also need information to check whether the service as a whole is meeting its goals. Additionally we need to collect information about children and young people in care in order to meet its legal duties.

What allows you to use my information?

We are required to collect data regarding children in care in order to meet legal responsibilities. Section 22(3) of the Children Act 1989 requires councils to make sure children in care are safe and well. This involves supporting children in places that meet their needs. For some children this is foster care, for others, it is residential care. To keep children safe and well, we need to collect data to make sure that all decisions are made on the basis of sound evidence. Information is also used to improve the service, to make sure all children are offered a high level of care and support.

Who will my information be shared with?

There will be two parties:

Cheshire West and Chester Council

  • social work practitioners (for children in their caseload)
  • children’s social care senior managers
  • independent reviewing officers (for children in their caseload)
  • safeguarding senior managers
  • insight and intelligence (for analysis purposes)
  • public service reform (for service improvement purposes)

Foster Care provider organisation

  • access to case information regarding children in their care

Do I have to provide this information and what will happen if I don't?

The collection of this information is a legal requirement for children in care. We are required to act as corporate parents for children who are looked after by the Children’s Act 1989 s20 and s31. In order to make sure high quality services are delivered to children in care, we are required to collect data on children’s lives, the type of care delivered and whether children benefit from their care.

How long will you keep this data for and why?

The looked after children retention schedule requires us to keep this data for 75 years under the following provision:

We are required to retain for 75 years 'any other document created or considered as part of any assessment of child’s needs, or of any review of child’s case'.

How will my information be stored?

Personal information will be captured and retained electronically via the current CRM solution for children’s social care, Liquidlogic. Information relating to the management of the service will be stored in a SharePoint record centre, and retained in accordance with the Freedom of Information Act 2000.

Your rights

Under data protection law, you have rights including:

  • your right of access - you have the right to ask us for copies of your personal information
  • your right to rectification - you have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • your right to restriction of processing - you have the right to ask us to restrict the processing of your information in certain circumstances
  • your right to object to processing - you have the right to object to the processing of your personal data in certain circumstances

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
