Petition Scheme Privacy Notice

Who will own my data once I submit it?

We will own your data once it has been submitted.

Why do you need my information?

Democratic services manage the petition scheme on behalf of us.

When we collect and use your information, we need this to:

  • process your petition and send your details to the relevant service to respond
  • communicate with you regarding the petition which you have submitted
  • use your name and signature to schedule a consideration at overview and the Scrutiny Committee if your petition has received signatures of at least 0.5% of the borough population
  • use your name and signature to arrange a full Council or Cabinet debate if your petition has received signatures of at least 1% of the borough population

The information that we collect about you is:

  • your name, address, postcode, phone number, email address and signature
  • the IP address that you accessed any of our online services from

At times we may also collect sensitive information about you, if you chose to include it in your petition, called special category data such as; political opinions.

What allows you to use my information?

When we collect and use your personal information for our petition scheme, we do so as part of our public duties as a local authority in order to manage your petitions effectively. The legislation, policies and guidance that allow us to do this includes but is not limited to:

  • General Data Protection Legislation Article 6 part e
  • General Data Protection Legislation Article 9 part g
  • Local Government Act 2000
  • The Local Authorities (Referendums)(Petitions)(England) Regulations 2011

Who will my information be shared with?

We will not share your information unless your petition asks us to carry out an action. If the petition involved has asked for an officer to contact you, we will pass your contact details to them, so that they can discuss your petition in more detail.

Do I have to provide this information and what will happen if I don't?

If you do not provide your contact details we will be unable to provide you with a response. If a petition is received with no contact details then there is no one who we can provide a response to so we reserve the right to stop working on the petition.

How long will you keep this data for and why?

Electronic copies are retained for six years after date created and securely destroyed.

How will my information be stored?

Your information is held securely on systems within our IT network. Any paper documents are held in a restricted access area.

Your rights

Under data protection law, you have rights including:

  • your right of access - you have the right to ask us for copies of your personal information
  • your right to rectification - you have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
  • your right to restriction of processing - you have the right to ask us to restrict the processing of your information in certain circumstances
  • your right to object to processing -you have the right to object to the processing of your personal data in certain circumstances

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
