Ending the tenancy

There are strict rules on ending a tenancy and preventing homelessness. Both landlords and tenants must give correct written notice. Tenants must give at least four weeks notice. Landlords must give at least eight weeks notice for a no fault eviction (section 21).

Landlords can serve a Section 8 notice if the tenant has breached the terms of the tenancy agreement. The length of notice to be given depends on the tenancy breach and could include rent arrears, damage to the property, or anti-social behaviour. The notice initiates the legal process for regaining possession of the property. Court orders may be required .

If you have been served a notice or told by the landlord that they will be asking you to leave, it is very important to get good advice as soon as possible. There are a number of organisations available. Early intervention can help prevent homelessness.

The rules on ending a tenancy are going to change when the Renters Rights Bill becomes law.

It is unlawful for a landlord to ask you to leave without following the correct procedures. Contact the Police if you believe there is an illegal eviction with threats of changing locks etc.
