Section 106 agreements
When new developments are built, they can put extra pressure on local services and infrastructure, things like schools, roads, health facilities, and green spaces. Section 106 agreements (sometimes called 'planning obligations') are legal agreements between developers and the Council that help manage these impacts. They ensure developments contribute positively to the community and remain sustainable.
These agreements are designed to mitigate the impact of development so that it is acceptable in planning terms. For example, they might secure funding for additional school places, affordable housing, improvements to roads, cycle paths or public transport, and new or enhanced open spaces and community facilities. By doing this, Section 106 agreements make sure that growth is balanced with the needs of the local area.
Planning obligations can only be required if they meet the three statutory tests set out in the Community Infrastructure Levy (CIL) Regulations. They must be necessary to make the development acceptable in planning terms, directly related to the development, and fairly and reasonably related in scale and kind to the development. These tests ensure that obligations are proportionate and focused on the actual impact of the specific development.

How do I check compliance?
You can request this information from us by completing the following form. You will need to provide information contained within your search so you need have this to hand before proceeding.
How much does it cost?
If a search has revealed that there are multiple Section 106 agreements and you require confirmation that each one has been complied with the fee will be £145 per agreement.
What happens next?
You will receive an email from a member of our team with your response. We aim to get this information back to you as soon as possible. Responses can take up to six to eight weeks depending on the complexity of the agreement.
